According to the court, there were no reasons for the bank insolvency.
The Kyiv’s District Administrative Court cancelled NBU decision on the insolvency of Bank Mykhailvosky and the decision of the Individual’s Deposit Insurance Fund on the liquidation of the bank, according to mass media, UA1 reports.
According to the court, there were no reasons for the insolvency of the bank. The court also stated that the transfer of UAH 1,507 bln from the account of Investment Payments Center to the individuals’ accounts though increased IDIF obligations, but it was not the “bank operations”, because the Bank Mykhailovsky was not the party to the loan agreements, but just fulfilled the client’s instructions.
In the meantime, the court declined “to obligate NBU to take all necessary measures on the recovery of Bank Mykhailvosky PJSC as the bank”.
The National Bank is preparing to appeal the judgment.
The sole owner of the bank filed lawsuit to the District Administrative Court – Ecosipan company.
It was previously reported that as of May 1, the courts renewed the operation of 12 banks, liquidated by Gontareva.
