Naftogaz of Ukraine NJSC started the process of collection of the debt, amounting to USD 2.6 bln, from Gazprom PJSC in foreign courts for enforcing the decision of the Arbitration Institute of the Stockholm Chamber of Commerce, the source in Ukrainian government reported to Interfax-Ukraine.
According to it, the process is being conducted in Switzerland, Netherlands and Great Britain within Article 5 of New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards.
Gazprom will probably challenge the seizure in local courts. If the court rejects, then we will be to say that the seizure was imposed, - the interlocutor to the agency noted.
It was previously reported that the arbitration process between Gazprom and Naftogaz of Ukraine on the transit contract can affect the assets of offshore pipeline design companies Nord Stream and Nord Stream 2.
It refers to the imposition of injunctive measures on the shares of Nord Stream AG and Nord Stream 2 AG. According to its data, these shares are already frozen.
Interfax does not have the official confirmation of information about the seizure of the shares of design companies Interfax. Gazprom’s press office has only just said that it deals with this question. Naftogaz of Ukraine still did not reply to the request. The representative of Nord Stream 2 is now unavailable for comments.
Reportedly, Stockholm Arbitration Court ruled that Gazprom pays Naftogaz the fine, amounting to 4.7 bln dollars. Gazprom filed appeal on the full cancellation of the decision to the Svea Court of Appeal.
As per the results of two arbitration disputes between the companies on gas delivery and transit, Gazprom should pay NJSC USD 2.56 bln.
In late March, the Chief Commercial Officer of NJSC Yuri Vitrenko noted that the process of collection can take up to half a year.
He, in particular, did not exclude the seizure of the gas of Russian company in underground storages of Europe or the shares of Nord Stream operator in Swiss Court for collecting the debt.
