Naftogaz claims three billion dollars from Gasprom.
The Russian company is also obliged to stop violating the antimonopoly legislation of Ukraine.
The Antimonopoly Committee of Ukraine has revealed the details of the decision, by which Gazprom is found guilty for abusing its monopoly position on gas transit market through Ukrainian territory and infringed interests of Naftogaz, Correspondent.net reports.
AMCU imposed the fine, amounting almost to UAH 86 billion ($3.27 billion), on the Russian company and ordered to pay it within two months.
In addition, within this period Gazprom is obliged to stop violating antimonopoly legislation of Ukraine and agree new, “justified” conditions of gas transit.
“For fulfilling obligations the defendant should use any legal means, in particular negotiations with NJSC “Naftogaz”, as per results of which the justified rules for acquisition and realization of natural gas transit on the territory of Ukraine should be established, including with the consideration of provisions of the agreement on establishing energy community”, the message says.
Previously the Head of Committee Yurii Terentiev stated that in 2009-2015 Gazprom violated conditions of the contract with Naftogaz and ignored any request on amending cooperation terms to economically justified and mutually profitable.
The Head of the AMCU qualified the drastic reduction of gas volumes, flown by Gazrprom to Europe through the Ukrainian territory, as the violations of the contract, concluded with Naftogaz. Naftogaz assessed its losses from slump in transit volumes in the amount of six billion dollars.
On January 22, 2016, Terentiev informed that AMCU decided to impose the fine, amounting to UAH 85 billion, on Gazprom.
Gazprom called Kyiv’s claims untenable and characterized threats to impose fine as “the attempt to exert pressure”.
