The agreement on transfer of Petro Poroshenko’s share to the blind trust (trust property) was signed on January 14, 2016, Poroshenko’s financial adviser, ICU Managing Director Makar Paseniuk said to journalists, Interfax-Ukraine reports.
According to him, one of the parties was represented by Poroshenko’s offshore company Prime Asset Partners Limited.
In his turn, Vadim Medvedev, Associate at Avellum Partners, acting as the legal adviser of the President, assured that Poroshenko lost any control over «Roshen».
«This agreement clearly stipulates that the trust is irrevocable, i.e. the company cannot cancel it without permission. And, secondly, the trust is formed upon the standard of blind trust: trust beneficiaries do not have the right to obtain from the manager or any other persons, related to the trust, information on assets of this trust and what is going in it.»
He explained that trust agreement cannot be terminated or somehow amended until Poroshenko remains the President of Ukraine.
«The agreement was signed by reputable international banking group, on which Petro claimed in January during his press-conference. Unfortunately, our obligations as advisers in this process currently do not let us provide more information and show more details of this document», - Medvedev said.
Paseniuk forecast that in the nearest future the information on the professional manager will be officially announced. He explained that, taking into account the risks of Ukraine and the fact that Poroshenko is the politically exposed person, the search process of such professional manager was enough complicated.
«We spent much time, notwithstanding that this is a part of group, which is involved in sale of this business, persuading their independent colleagues so they agree to accept to the trust», - he said.
He added that the part of British legislation on sanctions and financial monitoring applies to companies from the British Virgin Islands and that is the jurisdiction, from which Ukrainian authorities can obtain information, required for control, and the creation of company was caused by the absence of structure of trust agreement on Ukrainian legislation.
As it is known, Poroshenko claimed about transfer of his share in «Roshen» during the press-conference on January 14 – on the same day, on which, according to Paseniuk, it was done.
On April 3 the world’s media simultaneously published a large investigation, exposing the involvement of many world leaders and famous persons of different professions in concealment of large amounts of money in offshore companies.
This list included President of Ukraine Petro Poroshenko and President of Russia Volodymyr Putin. Poroshenko’s actions can contravene the law, as he opened a new company, holding the President’s post, and did not indicate this asset in his declaration.
Claims against Poroshenko consist in the concealment of the fact of creation of companies in offshore.
His lawyers have already given the explanation on this matter, assuring that there were no violations.
