The court found the Deputy Energy Minister guilty of illegal classification of requested information.
Kyiv Shevchenkovsky District Court found Deputy Energy Minister Igor Nasalyk guilty of the unreasonable classification of requested information, Dostup k pravde (Access to Truth) reports.
Thus, it is noted that the requester attempted to receive some documents regarding investment programs, approved by the Ministry within 2016, “however, he was told that the approval of the licensees’ investment programs by the Ministry is connected with the process of approval of decisions prior to their public discussion and approval, consequently, such information is classified” – “In the court’s opinion, the regulations, specified by the executor, evidence that the requested information is not classified as well as there are no other restrictions; accordingly, the disclosure of such information will not cause significant damage to these interest”.
