The scandalous law on electronic declaration was passed with Poroshenko’s amendments.
The Verkhovna Rada of Ukraine has passed the last law (out of the so-called visa-free package) on electronic declaration (№3755). In total 278 people’s deputies voted for such decision, Correspondent reports.
Previously the scandalous document, due to which the visa-free regime of Ukraine with EU could fall apart, was vetoed by President Poroshenko. The President introduced his amendments to “European integration” law.
PEO informed that the proposals, developed by the Presidential Executive Office and civil community, were endorsed by the European Union.
In particular, the President’s proposals provide: Introduction of electronic declaration in 2016, starting from officials, judges and prosecutors
Criminal responsibility for false information in declarations is introduced in 2016, as it was previously supposed. Simultaneously the responsibility itself is weakened, - it occurs, if the amount of discrepancy exceeds 250 minimum salaries, i.e. UAH 300 ths. Sanctions, alternative to apprehension, are being considered.
The introduction of administrative responsibility for false information in declaration for the amount from 100 to 250 minimum salaries, i.e. more than UAH 140 ths.
The identification of family members of the declarant’s family is left unchanged.
For valuable movable property the threshold of declaration have increased from 50 minimum salaries to 100 minimum salaries, and for expenses – to 50 minimum salaries.
The requirement to indicate parties in declarant’s deals has been withdrawn. Meanwhile, as per the request of NCPA the declarant should provide them.
The procedure for correction of declaration has been prescribed: “within 7 days after the submission of declaration the subject of declaration has the right to submit the corrected declaration”.
NCPA’s duty to conduct declaration review “based on the information, received from individuals and legal entities, from mass media and other sources, on possible reflection in declaration of false information” has been prescribed.
