The new constitutional authority will be allowed to appoint, dismiss and transfer judges as well as give consent to their apprehension and arrest.
The Law on High Council of Justice will come into force on Thursday, January 5, RBC-Ukraine reports.
Recently, Holos Ukrainy published the whole wording of the document. In compliance with it, the law allows significantly extending authorities of the new High Council of Justice in comparison to the former High Council of Justice.
Thus, the High Council of Justice will be allowed to appoint and dismiss judges, transfer them as well as give consent to their arrest and apprehension of judges. Previously, the Verkhovna Rada of Ukraine addressed these issues.
As President of Ukraine Petro Poroshenko previously noted, the Law On High Council of Justice will allow neutralizing the political influence on the judicial power of the country.
It should be reminded that on January 3, Petro Poroshenko signed the law on creation of the High Council of Justice and the Law On Introduction of Amendments to the Budgetary Code”, which should ensure the funding of a new constitutional authority.
On June 2, the Verkhovna Rada adopted amendments to the Constitution in terms of justice as well as the related law On Court Organization and Status of Courts. The High Council of Justice will appear in Ukraine and will have broader authorities. The amendments to the Constitution in terms of justice came into force since September 30. The Presidential Draft Law On High Council of Justice was registered in the Verkhovna Rada on September 23 and qualified by the President as urgent.
