The Supreme Court of Russia denied Ukraine’s cassation appeal to the ruling of the Arbitration Court of Moscow District on the dispute with Tatneft for USD 144 mln, according to the court ruling dated October 31, EP reports quoting Ukrainian News.

In August, the Federal Arbitration Court of Moscow District overturned the ruling of Moscow Arbitration Court, by which the latter suspended the proceeding on the case, related to enforcement of the ruling of the International Commercial Arbitrage, issued on July 29, 2014, on collecting the compensation, amounting to USD 144 mln, from the Ministry of Justice of Ukraine to cover the loss of Tatneft’s stake in Ukrtatnafta.

“To deny submission of cassation appeal for hearing in the court session by theChamber for Commercial Disputes of the Supreme Court of Russian Federation”, according to the court ruling.

Previously, the ruling of Moscow Arbitration Court dd. July 4, 2017, suspended the proceeding on acknowledgment and enforcement of the specified ruling of the Internal Commercial Arbitration on collecting USD 144 mln from Ukraine.

Not agreeing with the approved court order, Tatneft filed cassation appeal to the Federal Arbitration Court of Moscow District.

After considering Tatneft’s cassation appeal, the Arbitration Court of the Moscow District overturned the ruling of the lower court and submitted the case to a new trial in the court of the first instance.

Ukraine, represented by the Ministry of Justice of Ukraine filed appeal against the ruling of the court of cassation instance to the Supreme Court of Russia.

It should be reminded that Russia’s Tatneft filed lawsuits to Moscow and London courts against Ukraine for collection of USD 144 mln in the case of Kremenchutske OPP.
